Acceptance of Terms 

Your use of our website including: subscribing on this or any other Habitat Schoolhouse Inc. website; use of digital services or products on this website; or your provision to us of any content or personal information constitutes your agreement to these terms, including the Privacy Notice.  Please do not use this site, provide any content or personal information if you do not agree to the terms or if your jurisdiction will not honor them.

These terms and conditions of service (the "Terms") are a legal and binding agreement between you and the Society governing your use of our sites, member.habitatschoolhouse.com and www.habitatschoolhouse.com, which includes but is not limited to products, software and services offered by way of the website such as any Resources, Curriculum, Videos, Photography, Content, Printables, Articles, Subscriptions, and other applications that link to these Terms (the "Service").

Please review the Terms fully before you continue to use the Service. By using the Service, you agree to be bound by the Terms as well as our Privacy Notice, which also governs your use of the Service. If you do not agree with our Terms, please discontinue using the Service. We may update the Terms from time-to-time. We will inform you before any change takes effect. The Terms were last updated on February 28th, 2025.

Your use and browsing of the Service is at your risk. If you are dissatisfied with any of the materials contained in the Service, with the quality of Service, or with these Terms, your sole and exclusive remedy is to discontinue accessing and using the Service.

For information about privacy and information security, including consent to international data transfers and disclosure please consult the Privacy Notice.  Please do not provide, or allow others to provide, personal information about anyone unless you, on your own behalf and on behalf of anyone whose information you provide: (a) have reviewed and agree with the Privacy Notice, and (b) are authorized to, and do, consent to provide personal information to Habitat Schoolhouse.

Intellectual Property

The Service is owned by Habitat Schoolhouse Inc. All of the content featured or displayed on the Habitat Schoolhouse websites, including, but not limited to, still images, text, pictorial works, video images, still images of video, graphic designs, audio recordings, multimedia combinations, and computer programs, including web-based programs (“Content”) is owned or licensed by Habitat Schoolhouse Inc.

Pursuant to the copyright and trademark laws, you agree:

  1. To download only the content Habitat Schoolhouse designates as being offered for downloading to any single computer, and only a single copy of any such content for personal and noncommercial use.

  2. Not to reproduce, distribute, modify, re-post on another Service (regardless of the server on which the content is stored), or sell any content without specific written authorization from Habitat Schoolhouse Inc.

  3. To maintain any and all copyright or other proprietary notices embedded in or attached to any content.

  4. To refrain from framing, inline linking, or mirroring any portion of the Habitat Schoolhouse Inc.

  5. Habitat Schoolhouse Inc. retains all of your ownership rights in comments you post, translations you provide or other content you provide to Habitat Schoolhouse Inc.

  6. By uploading your content, however, you grant Habitat Schoolhouse Inc. (which includes its parent, subsidiaries, affiliates, joint ventures, and licensees) the following rights: a worldwide, perpetual license to display, distribute, reproduce, and create derivatives of Your Content, in whole or in part, without further review or participation from you, in any medium now existing or subsequently developed, in editorial, commercial, promotional, and trade uses in connection with the HS brand, HS Products, and Habitat Schoolhouse’s branded channels on existing and future social media platforms (such as Facebook, Instagram, Twitter, Snapchat, Pinterest, and subsequent new platforms). The Habitat Schoolhouse may license or sublicense, in whole or in part, to third parties rights in Your Content as appropriate to distribute, market, or promote such HS Products or HS brand through any existing and future media, channels, or platforms. You also grant the Habitat Schoolhouse permission to use and authorize others to use your name and any profile picture you provide in association with Your Content for identification, editorially, publicity related to Your Content or the Habitat Schoolhouse, and for similar institutional promotional purposes. You also agree that the Habitat Schoolhouse may make Your Content available to users of the Service who may display and redistribute it in the same way that Habitat Schoolhouse makes all other Content available.

  7. The Habitat Schoolhouse Inc. may use your content, without compensation to you, in any HS Products that feature your content in the context of, in direct promotion of, or otherwise strongly identified with (beyond mere attribution), the special section or community of Habitat Schoolhouse Inc. to which it was submitted, or successor sections or communities of the service.

  8. The Habitat Schoolhouse Inc. may exercise its rights to use your content in HS Products other than described, immediately above (e.g., for an “App,” a book or e-book, merchandise, etc.), and will pay you at the Habitat Schoolhouse’s rates.

  9. To enable the Habitat Schoolhouse Inc. to use your content in HS Products, HS may request you to provide Your Content in other formats, and if technically possible, you agree to provide Your Content in such other formats so long as Society pays you the reasonable out of pocket costs of providing Your Content in such other formats.

  10. Any payment to you is conditioned upon you keeping your subsciption information up-to-date and you completing any paperwork that the Society requires to make payments to third parties. The Habitat Schoolhouse also reserves the right not to make payment to you if the Habitat Schoolhouse reasonably believes that to do so would violate applicable law.

  11. Pursuant to Title 17, United States Code, Section 512, notifications of claimed copyright infringement on the Habitat Schoolhouse should be sent to our designated agent. If you believe that your work has been used in a way that may constitute copyright infringement, please provide the Habitat Schoolhouse’s designated agent the following information:

    • An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;

    • A description of the copyrighted work that you claim has been infringed;

    • A description of where the material that you claim is infringing is located on Habitat Schoolhouse (such as the URL);

    • Your address, telephone number, and e-mail address;

    • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and

    • A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf. The Habitat Schoolhouse’s designated agent for notice of claims of copyright infringement on the Habitat Schoolhouse website is its Chief Executive Officer who can be reached by email at office@habitatschoolhouse.com. This contact information is only for reporting alleged copyright infringements.

Educational Use of Content

With respect to Content designated as available for download for educational purposes (“Downloadable Content”), Educators or Learners may download and exhibit such Downloadable Content on a stand-alone basis or embed in their own presentations, handouts, worksheets, other educational aids, homework, school reports, and other educational assignments or projects. For the purposes of this Agreement, “Educators or Learners” consists of librarians, teachers, support staff, administrators and other staff of educational institutions, students, and adults supporting such students’ learning. The following restrictions apply to Educators and Learners concerning all Downloadable Content:

  • You may not disseminate Downloadable Content beyond your particular educational institution, organization, or home.

  • Under no circumstances may you use Downloadable Content for commercial purposes.

  • You may not make any modifications to Downloadable Content and must preserve all Habitat or Licensor credits, copyright notices and other proprietary notices; provided, however that an Educator may modify questions or other classroom activities for use only in his/her classroom, subject to the obligation to correctly cite to the original Downloadable Content.

  • You may not make use of, or allow or enable the use of, Downloadable Content in a manner in which it is re-posted, framed, or mirrored on any other websites, regardless of educational use, but may store Downloadable Content on password-protected computer networks administered by your school or school system.

  • You may post only products you have purchased individually or downloaded trough your membership that contain Downloadable Content and only to a password-protected website administered by your school or school system, or by the Habitat Scoolhouse.

  • If you embed Downloadable Content in the form of video material (e.g., through a video player) you must also comply with the HS Terms of Service for Your Conduct with respect to Video Players.

Content Disclaimer. The text and other material in Educational Opportunities may include the opinion of the specific instructor and are not statements of advice, opinion, or information from the Society. If you feel you might be offended by the content of the Educational Opportunities, you should refrain from registering for the Educational Opportunities.

Subscriptions

Some Habitat Schoolhouse Products or Services require paid subscriptions and the acceptance of supplemental terms to access. By signing up for a subscription, you agreed that your subscription will be automatically renewed and, unless you cancel your subscription, you authorized us to charge your payment method for the renewal term. You agree that we can change the terms of the subscription with advance notice to you and an opportunity for you to cancel. The period of auto-renewal will be the same as your initial subscription period unless otherwise disclosed to you. The renewal rate will be no more than the rate for the immediately prior subscription period, excluding any promotional and discount pricing, unless we notify you of a rate change prior to your auto-renewal, in which case you will have the right to cancel the renewal of your subscription. From time to time, we may offer eligible users to begin their subscription with a promotional period, during which you have access to a Habitat Schoolhouse Product or Service at no charge . If you register for such a promotion, we will begin to bill your account when the promotional period expires, unless you cancel your subscription before that time.

Unless otherwise disclosed when you subscribe, you have the right to cancel your Habitat Schoolhouse subscription at any time. When a subscription is canceled, due to the nature of digital products, you will not receive a refund. If you cancel your subscription, you will still be obligated to pay other charges incurred by you in the course of using the Habitat Schoolhouse Product or Service prior to the date of cancellation. If you pay a periodic subscription fee for a Habitat Schoolhouse Product or Service, we will provide you with at least 30 days’ notice of changes to the fees or billing methods in advance of their effective date and you will be able to cancel your subscription prior to such change.

If you cancel your subscription within three business days of signing up for or converting from a free trial to a paid membership, we will refund your full membership fee; provided that we may charge you (or withhold from your refund) the value of Habitat Schoolhouse benefits used by you and your account during this three business day period. Habitat Schoolhouse will charge you or withhold from your refund up to $30.00USD to cover the cancellation, and refund you the remaining amount.

If you cancel at any time outside of this three business day grace period and request a refund, you will be refunded only if you or your account did not make any eligible downloads, views, or take advantage of any Habitat Schoolhouse benefits, including logins, since your latest Habitat Schoolhouse membership charge. Habitat Schoolhouse memberships or subscriptions redeemed with a gift code or promotional code are not refundable.

In order to use certain functionality of the Service, you may be required to complete a registration process and create an account. As a registered user of the Service, you agree to (a) provide true, accurate, current, and complete information about yourself as prompted by the Service registration form ("Registration Data"), and (b) maintain and promptly update the Registration Data to keep it true, accurate, current, and complete. Upon completing the registration process, you will receive confirmation of a password and username. You are responsible for maintaining the confidentiality of the password and username, and you are fully responsible for all activities that occur under your password or username. You agree to (a) immediately notify the Society of any unauthorized use of your password or user name or any other breach of security; (b) exit from your account at the end of each session; and (c) defend, indemnify, and hold harmless the Society from any loss or damage arising from your failure to keep your account information secure and confidential, including, without limitation, the unauthorized use of your password or username. 

By registering, you consent to the collection of your data, including, without limitation, Registration Data, by Habitat Schoolhouse or through a third party service and processing of such data by the Habitat Schoolhouse connection with your use of the Service. You consent to the technical processing and transmission of data involved in your use of the Service, including, without limitation, Registration Data, and you acknowledge that processing may involve (a) transmission of such data over various networks; and (b) modifying such data to conform and adapt to technical requirements of connecting networks or devices.

All subscription content is released periodically throughout the year with new content being added throughout the year. Habitat Product and Service availability are subject to change without prior notice. You may cancel at any time, if you cancel your membership you will no longer have access to Habitat Product and Service content. If you are under 18 years old, your parent or guardian must fill out this subscription form for you. Habitat Schoolhouse workbooks and graphics shown in any Habitat Product and Service promotion or webpage are provided for illustrative purposes only. The actual Habitat Schoolhouse Product or Service you receive may differ from the images displayed on our website. This is due to the constant nature of the standards for educational resources, particularily curricula, changing from year to year. Habitat Schoolhouse periodically updates the Habitat Product and Service to match the current educational standards set our by the Ministry of Education of Canada, the U.S. Department of Education, and Next Gen Science. You may cancel by sending an email to info@habitatschoolhouse.com at any time during your subscription. Due to the nature of digital products, refunds are not applicable.

Cancellation & Return of Goods

You may have the right to cancel an order placed for a Habitat Schoolhouse product or service – depending on the nature of the Service. Please read the following information carefully so you understand your right of cancellation.

If you wish to cancel, you must do so by following the cancellation instructions for the particular product or Service. A sample cancellation form is available here.

i. Cancelling Subscriptions: Please see the information above on the process for cancelling subscriptions in our Subscriptions section, above.
ii. Digital Content: When you purchase a license to access digital content or virtual items, you acknowledge that you have lost the right to cancel. Due to the nature of digital content, digital products and services are non-refundable.
iii. Physical Goods: You have the right, within thirty (30) days from the date of your receipt of physical goods, to cancel our contract with you and return the goods. This right does not apply to goods stated by us on the Habitat Schoolhouse Products to be non-returnable, including but not limited to:

  • Any products with a seal, where the seal is broken, such as audio and video recordings, computer software, and CD’s, DVD’s or other physical media that have been supplied in sealed packaging; and

  • Personalized Goods: We reserve the right to refuse personalized orders at our discretion. Inappropriate use of our personalization service will cause your order to be cancelled and any payment refunded.

These cancellation rights are separate from and in addition to your rights should any item we supply be faulty. If you are returning goods that are not faulty, you are required to pay for the cost of returning the goods to us and we may deduct a reasonable amount if you used the goods.

The Order Process

You will have the opportunity to review and confirm your order, including delivery address (if applicable), payment method and product details. We will send to you a notice when we accept your order and our acceptance will be deemed complete and for all purposes to have been effectively communicated to you at the time we send the notice. At such time, the contract for sale will be made and become binding on both you and us. The risk of loss in any goods you purchase and the responsibility to insure them passes to you when the relevant goods are delivered.

We reserve the right to refuse or cancel any order prior to delivery. Some situations that may result in your order being cancelled include system or typographical errors, inaccuracies in product or pricing information or product availability, fairness among customers where supplies are limited, or problems identified by our credit or fraud department. We also may require additional verification or information before accepting an order. We will contact you if any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after we have processed your payment but prior to delivery, we will refund your payment.

Contests and Promotions

Contests and other similar promotions that you enter on a Habitat Schoolhouse Product or Service or in connection with Habitat Schoolhouse integrated with a third-party website, service, application, platform, and/or content (“HS Promotion”) may be subject to official rules and/or conditions that are supplemental to this Agreement, and which may provide details governing the HS Promotion such as eligibility requirements, entry instructions, deadlines, prize information and restrictions. If you wish to participate in any HS Promotion, please first review the applicable official rules and/or conditions. If a HS Promotion’s official rules and/or conditions conflict with this Agreement, the provisions contained in the official rules and/or conditions govern and control the HS Promotion. Your entry to a HS Promotion constitutes User Generated Content (as defined below) and is subject to all provisions of this Agreement that govern your submission and our use of your User Generated Content.

User Generated Content

User Generated Content. The Habitat Schoolhouse may ask for or allow you to communicate, submit, upload or otherwise make available text, chats, resources, articles, images, audio, video, contest entries or other content (“User Generated Content”), which may be accessible and viewable by the public. Access to these features may be subject to age restrictions. Whether a Habitat Schoolhouse Product or Service made available by us or in connection with Habitat Schoolhouse appears on a Habitat Schoolhouse website, service and/or platform or is integrated with a third-party website, service, application, and/or platform, you may not submit or upload User Generated Content that is defamatory, harassing, threatening, bigoted, hateful, violent, vulgar, obscene, pornographic, or otherwise offensive or that harms or can reasonably be expected to harm any person or entity, whether or not such material is protected by law.

In most instances, we do not claim ownership of your User Generated Content; however, you grant us a non-exclusive, sublicensable, irrevocable and royalty-free worldwide license under all copyrights, trademarks, patents, trade secrets, privacy and publicity rights and other intellectual property rights for the full duration of those rights to use, reproduce, transmit, print, publish, publicly display, exhibit, distribute, redistribute, copy, index, comment on, modify, transform, adapt, translate, create derivative works based upon, publicly perform, publicly communicate, make available, and otherwise exploit such User Generated Content, in whole or in part, in all media formats and channels now known or hereafter devised (including in connection with the Habitat Schoolhouse Products and Services and on third-party websites, services, applications, and/or platforms), in any number of copies and without limit as to time, manner and frequency of use, without further notice to you, without attribution (to the extent this is not contrary to mandatory provisions of applicable law), and without the requirement of permission from or payment to you or any other person or entity. You agree that submission of User Generated Content does not establish any relationship of trust and confidence between you and us, and that you have no expectation of compensation whatsoever (except as may be specifically stated in the provisions of the Habitat Schoolhouse Products and Services in connection with the submission, or arising from it).

You represent and warrant that your User Generated Content conforms to this Agreement and that you own or have the necessary rights and permissions including, without limitation, all copyrights, music rights and likeness rights (with respect to any person) contained in the User Generated Content, without the need for payment to any other person or entity, to use and exploit, and to authorize us to use and exploit, your User Generated Content in all manners contemplated by this Agreement; and you agree to indemnify and hold us harmless from any claims or expenses (including attorneys’ fees) by any third party arising out of or in connection with our use and exploitation of your User Generated Content resulting from your breach of this Agreement. You also agree to waive and not to enforce any moral rights, ancillary rights or similar rights in or to the User Generated Content against us or our licensees, distributors, agents, representatives and other authorized users, and agree to procure the same agreement to waive and not to enforce from others who may possess such rights.

To the extent that we authorize you to create, post, upload, distribute, publicly display or publicly perform User Generated Content that requires the use of our copyrighted works, we grant you a non-exclusive license to create a derivative work using the specifically referenced copyrighted works as required for the sole purpose of creating such a work, provided that such license shall be conditioned upon your assignment to us of all rights worldwide in the work you create for the duration of copyright in the User Generated Content, in all formats and media known or unknown to date, including for use on Habitat Schoolhouse Products and Services and on third party sites and platforms. If such rights are not assigned to us, your license to create derivative works using our copyrighted works shall be null and void.

We may monitor, screen, post, remove, modify, store and review User Generated Content or communications sent through a Habitat Schoolhouse Product or Service, at any time and for any reason, including to ensure that the User Generated Content or communication conforms to this Agreement, without prior notice to you. We may terminate your account and access to the Habitat Schoolhouse Products and Services if your User Generated Content violates this Agreement, including unlawful postings or content, without prior notice to you. We are not responsible for, and do not endorse or guarantee, the opinions, views, advice or recommendations posted or sent by users.

Payments and Billing

When you provide payment information, you represent and warrant that the information is accurate, that you are authorized to use the payment method provided, and that you will notify us of changes to the payment information. We reserve the right to utilize third party payment card updating services to obtain current expiration dates on credit cards and debit cards.
